This Privacy Policy applies to the Dolce Vita branded physical retail stores, the website located at www.dolcevita.com, (the “Website”), and other offline or online services such as phone, mail, and e-mail operations, as well as our marketing contacts with you (collectively, the “Services”). This Privacy Policy also does not apply to information collected when you purchase our products in department stores that are not Dolce Vita stores, or on other third-party websites where our products are sold. Unless otherwise specified, personal information collected from these other channels is not provided to Dolce Vita, and Dolce Vita has no control over how they use the information that they collect.

This Privacy Policy is incorporated into and integrated into our Terms of Use (“Terms of Use”).

By accessing or using the Website, our Services, by accepting our Terms of Use, and/or by contacting us and providing any personal information, you consent to the collection and use of information by us in accordance with this Privacy Policy, as well as the Terms of Use. We collect personal information in order to provide you with our products and services.  In addition, your personal information helps us communicate to you our latest products, special offers, and information and events about which you might like to hear.  We also collect your personal information to help us design and improve our Website, and to share marketing with you based on your interests, previous purchases, and other interactions with the Services.  We also may correlate your personal information obtained from you with information from other sources (e.g., in order to prevent or detect fraud).

1. You Give Us Information: We collect information from you when you submit it to us through our Website, other digital media or in one of our stores.

The following generally describes the categories of personal information we may collect, and over the prior 12 months may have collected, about you.

• Identifiers, such as name, contact information (e.g., postal, mailing, billing, and/or shipping address, zip code, email address, telephone number), birth date, a unique PayPal identifier, and other similar identifiers;
• Categories of personal information related to the California Customer Records statute (Cal. Civ. Code § 1798.80), such as name and contact information (payment card information (e.g., credit or debit card numbers) is not collected or stored by Dolce Vita and is only processed by third-party providers);
• Commercial information, including information about a consumer’s purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale;
• Audio, visual, electronic or similar information, such as in-store video monitoring and call recordings created in connection with our business activities (e.g., customer service calls for training and quality control purposes);
• Internet or other electronic network activity information, such as type of browser and operating system, search history, or information on a consumer’s interaction with our Website;
• Approximate Geolocation Data, such as your current location; and
• Protected classification characteristics under California or federal law, such as age (40 years or older).

In-Store Shopping:

We have partnered with Leap Services, Inc. (“Leap”) to open and operate at least one of our physical retail stores. When you buy products or obtain services in such a store, Leap may ask you for certain personal information that it needs to process your purchase or provide you with the services you request. Please be aware that we are not responsible in any way for Leap’s privacy practices or for any use and/or misuse of any information that you provide to Leap. Leap’s privacy practices are subject to its own privacy policy, which we strongly suggest you review.

Personal information collected by Leap in connection with your in-store shopping experience may also be provided to us.

When you buy products or obtain Services in our stores, we may ask you for information we need to process your purchase or provide you with the Services you request, such as your name, mailing address, email address, telephone number, or zip code.  Depending on the payment method you use, and only as permitted by applicable law, we may ask for more information to verify your identity or to prevent fraud, including a government-issued ID number (e.g., driver’s license, state identification number, passport, or other ID number). You may refuse to provide such information, but you may not be permitted to complete your purchase if we cannot verify your identity. If you do provide us with such information, you consent to it being used in accordance with this Privacy Policy. We may also collect information about your purchase, such as the items purchased, the price of the items, the payment method used, and whether the product was on sale.

We may also use in-store video monitoring for security, quality control and other purposes, such as helping us understand customer behavior and traffic patterns within our physical locations. In furtherance of our security policy, in-store video may be used, at our discretion, to assist law enforcement in investigations and may also be turned over to governmental authorities, agencies or others pursuant to an order issued or authorized by a court of competent jurisdiction. Images captured by our in-store video monitoring will be maintained for a limited period of time.

Job Applications and Postings

You may view job openings and apply for employment with us through our Website. If you submit a resume, job application, or related materials or other information to us, we may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require Dolce Vita to review that information or consider you for employment. If you are interested in viewing opportunities at Dolce Vita or to submit a job application, please visit Careers and you may be redirected to an online career portal operated by a third party. We encourage you to review any terms and privacy policies posted on that portal.

We use the information we collect for various business purposes, including to:

• Advance our economic and commercial interests by providing the products or Services you may order, including processing orders and returns;
• Analyze trends and conduct research about improving our products and Services;
• Maintain and service customer accounts;
• Provide support and respond to questions from customers and Website visitors;

Our analytics providers may set and read cookies to collect this data and your web browser will automatically send data collected by those cookies to our analytics providers. Advertising and Google Ads

We use Google Ads and Google Analytics advertising features on our Website, which we use for the purposes set forth in this Privacy Policy. Through Google Ads, Google uses your Internet searches, cookies, and similar identifiers (e.g., pixel tags) to collect information about your visits to the Website and your interaction with our products and services to generate targeted advertisements to you on other websites that you visit across the Internet. We may also enable and implement Google Analytics advertising features on the Website. Content You Share

You may be able to post information and materials publicly, for example, in product reviews, chat areas, and other similar forums (collectively, “Forums”), subject to the Forum rules in our Terms of Use.  If you post any information in a Forum on the Website, it will be deemed public information and available to the general public.  Please do not post any personal information in a review or Forum.  We cannot guarantee that personal information you provide in a review or Forum will not be viewed by unauthorized persons. You understand that, even after removal, copies of personal information you provide in a review or Forum may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other Website users. We will make personal information you provide in a review or Forum available, including publicly available, to other Website users and to the public, as applicable and at our sole discretion.  If you do post personal information, you do so at your own risk, and consent to it being used as a submission, in accordance with our Terms of Use.

You may also be able to send certain content to other individuals using the Website.  To send information to others, we request both your email address and theirs.  We use this information only to fulfill your request.  We may retain the information you provide in connection with this feature.  We will not include any third-party advertisements within the messages sent to your friends.

Transfers of Personal Information During a Corporate Transaction

If Dolce Vita, or substantially all of its assets, were acquired, or in the unlikely event that Dolce Vita goes out of business or enters bankruptcy, Website and Services user information (which may include any of the categories of personal information described in the What Information We Collect section of this Privacy Policy) would be one of the assets that is transferred or acquired by a third-party.  You acknowledge that such transfers may occur, and that any acquirer of Dolce Vita may continue to use your personal information only in accordance with this Privacy Policy.

Social Media

Dolce Vita is active on social media. You may have the opportunity to comment on those social media platforms regarding Dolce Vita and the products we offer and/or to submit or upload related photographs and other materials. Dolce Vita reserves the right to post on the Website, other websites, and social media pages any comments, photographs, or content that you post on our social media pages or provide to us through social media.

The Website is not intended for individuals under the age of 13, individuals under the age of 16 in California, or any individuals under the legal age of majority in the jurisdiction they reside (collectively, “Minimum Age”). In accordance with the Children’s Online Privacy Protection Act (“COPPA”) and as applicable, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), we do not request or collect any personal information from anyone who we know to be under the Minimum Age. If you are under the Minimum Age, you should not register with, order or purchase from, or provide information to or from, us. If we become aware that a user of our Website is under the Minimum Age and has provided an online registration or other personal information without prior verifiable parental consent, we will take all commercially reasonable steps to delete such information from our files and not to use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). Right to Correct Inaccurate Information

You may have the right to request that we correct any inaccurate personal information that we have about you. Alternatively, you can use one of the contact methods outlined above, including submitting a verifiable consumer request.

Right to Request Deletion

You may have the right to request that we delete any personal information that we have collected from you.  However, we are not required to comply with a request to delete, if it is necessary for us to retain the personal information in order to:

• Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

• Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

Right to Opt-Out of “Sale” or “Sharing” of Personal Information

You may have the right to direct us to not sell your personal information or share your personal information for cross-contextual behavioral advertising purposes at any time (the “right to opt-out”). To exercise the right to opt-out, you (or your Authorized Agent) may click the “Do Not Sell or Share My Personal Information” link in the footer of our Website, email your request to opt-out to info@dolcevita.com, or set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. However, if you do not consent to our use of cookies or select this setting you may be unable to access certain parts of our Website or use all the features of our Services. Once you make an opt-out request, we will wait at least 12 months before asking you to reauthorize personal information sales. However, you may change your mind and opt back into the sale of personal information at any time by adjusting your cookie preferences to accept all or certain cookies. Limited Right to Opt-In to “Sale” or “Sharing” of Personal Information

We do not sell the personal information of consumers we actually know are less than the Minimum Age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least the Minimum Age, or the parent or guardian of a consumer less than the Minimum Age. Consumers who opt-in to personal information sales may opt-out of future sales at any time through the opt out methods described above.

Do Not Track Signals / Opt-Out Preference

California and Colorado law require us to let you know how we respond to web browser Do Not Track (“DNT”) signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information about your online activities over time. California and Colorado residents may opt out by broadcasting an Opt-Out Preference Signal, including the Global Privacy Control (GPC), depending on which browsers and/or browser extensions you use that may support such a signal. Identity Verification

As required by law, we may ask you to verify your identity and/or your authorized agent directly with us and directly confirm that you have provided the authorized agent permission to submit the request.  We note, should your authorized agent fail to submit proof that they have been authorized to act on your behalf, we will deny their request.

California Residents

This section of the Privacy Policy supplements, and should be read in conjunction with, the rest of the Privacy Policy.

Under California’s Shine the Light Law, if you are a resident of California, you may make a written request to us about how we have shared your information with third parties for their direct marketing purposes during the preceding calendar year.  In response to your written request, we are allowed to provide you with a notice describing the cost-free means to opt-out of our sharing your information with third parties with whom we do not share the same brand name if the third-party will use such information for its direct marketing purposes.  Please allow us thirty (30) days to provide you with a Third-Party Direct Marketing Opt-Out Form so you may request that your personal information not be disclosed to third parties for their direct marketing purposes.

If you are a resident of California, and your personal information is subject to the CCPA, then the rights described in State-Specific Privacy Rights above are only exercisable by you where applicable law grants you the right and where no exception or exemption applies. You may also have an authorized agent (if and only as permitted under applicable law) that you authorize to act on your behalf, however we have the right to authenticate such authorized agent’s authority to act, as described in the Identity Verification section of this Privacy Policy.

We do not knowingly collect any personal information that would be considered “sensitive” under applicable law.

You have the right to submit a verifiable consumer request that we disclose the following to you in a readily useable format covering the 12-month period preceding your request:

• The categories of personal information we have collected about you.
• The categories of sources of the personal information we have collected about you.
• The business or commercial purpose(s) for collecting personal information.
• The categories of third parties with whom we share personal information.
• The specific pieces of personal information we have collected about you.

You may only submit a request to know and receive a response two (2) times within a 12-month period.

Colorado Residents

This section of the Privacy Policy supplements, and should be read in conjunction with, the rest of the Privacy Policy.

If you are a resident of Colorado, and your personal information is subject to the CPA, then to exercise your rights, you must submit a consumer request, which must then be verified by comparing the personal information we have about you to pieces of personal information we will request in the course of processing your request. The rights described in State-Specific Privacy Rights above are only exercisable by you where applicable law grants you the right and where no exception or exemption applies. You may also have an authorized agent (if and only as permitted under applicable law) that you authorize to act on your behalf, however we have the right to authenticate such authorized agent’s authority to act, as described in the Identity Verification section of this Privacy Policy.

You have the right to submit a verifiable consumer request asking us to confirm whether we process personal information about you and to access your personal information, as well as to have such personal information provided to you in a portable (“data portability”) and, to the extent technically feasible, readily usable format. 

You may only submit a request for data portability no more than two (2) times per calendar year.

We do not use your personal information to profile you in furtherance of decisions that produce legal or significantly similar effects (as may be defined under applicable law). We also do not knowingly collect any personal information that would be considered “sensitive” under applicable law.

If we decline to take action on one of the State-Specific Privacy Rights mentioned above to you as a Colorado resident, you may submit an appeal by emailing us at info@dolcevita.com or by requesting an appeal through the Data Privacy Portal.

You may visit the Data Privacy Portal to exercise your rights under the CCPA or the CPA or submit a verifiable consumer request to know, correction, deletion, or other applicable right through one of the following methods:

At this time, requests are not available in other states of residence. We will continue to monitor developing privacy legislation to ensure compliance and will update our privacy policy accordingly.

We offer consumers a loyalty program, [ THE LIST ], which provides members with exclusive member perks, such as exclusive access to offers, early access to online sales events, exclusive discounts and other benefits and rewards. Consumers may opt in to the loyalty program by signing up on our website at Become a VIP & Join [ THE LIST ]. When consumers sign up for our loyalty program, they may be required to provide personal identifiers, including their first and last name, email address, birth date, and telephone number. [ THE LIST ] is only available to consumers on our Website and at select Dolce Vita store locations. The purpose of [ THE LIST ] loyalty program is to encourage repeat business with Dolce Vita and to enhance your shopping experience. Dolce Vita will never discriminate against you if you choose to exercise any of the privacy rights described in this Privacy Policy.

Consumers may cancel their participation in this program at any time by contacting our customer service team at 1 (877) 525-2833, Monday through Sunday, between the hours of 9:00 AM to 10:00 PM Eastern Time. Generally, we do not assign monetary or other value to personal information. Under certain laws, these services may be considered a “financial incentive”.
